| Protocol if an employee refuses to submit to a required test |
| All situations described below are considered a "refusal" for the ACI/COATS drug testing program. Written documentation of a "refusal to test" should be provided to the program administrator, Midwest Toxicology Services. The "refusal" will be entered into the database and a written "refusal" report will be issued to you. An on-line form is available to document a refusal and transmit to Midwest Toxicology Services. |

| Refusal Situations: |
- Failing to appear for any required test within a reasonable time or failing to remain at the testing site until the testing process is complete. This includes:
- The employee refuses to report to the collection facility after being instructed by the appropriate supervisor.
- The employee reports to the collection facility, but refuses to provide a specimen.
- The employee reports to the collection facility, says he can't go or tries but doesn't provide an adequate specimen; leaves without providing an adequate specimen.
- Failing to provide an adequate specimen within the required time (2 hours) unless a legitimate medical explanation exists. This determination of whether a valid medical explanation exists rests with the Medical Review Officer.
- Failing to undergo a medical examination or evaluation to meet medical explanation requirements in item 2 above.
- A test result is issued as an adulterated or substituted test result.
- Failing to cooperate with any part of the testing process (e.g., refuse to empty pockets when so directed by the collector, behaves in a confrontational way that disrupts the collection process).
- Failing to permit an observed collection if required.

| Suggested Protocol In Handling Refusals |
- If any of the refusal situations described above occur, verbally inform the refusing employee that the consequences of his/her action will result in a refusal being entered into the ACI/COATS database. The refusal will carry the same consequences as having a positive test. Document all details using the on-line form and transmit to Midwest Toxicology by email or fax. If you are unable to fax or email this information, call MTS to provide the information.
