Handling Policy Violations Positive Tests And Refusals |
| Return-to-Duty Process - Steps the employee must complete: |
- Schedule and complete an evaluation with a Substance Abuse Professional (SAP). The SAP must recommend a program of either education or treatment and, at a minimum, their recommendation must be one or more separate education and/or treatment sessions beyond the initial evaluation.
- Complete all of the SAP's recommendations.
- Present the program administrator (Midwest Toxicology Services) with a letter from the SAP that states he/she was evaluated, completed (or is in the process of completing) education or treatment recommendations, is fit for duty, can be returned to work and is eligible to take a return to duty test.
- Additionally, a minimum of 14 days from the date of their positive test (or other violation) must have passed before a return to duty can be taken.
- Arrange for a return to duty test, test negative and have it entered into the ACI/COATS database.
- If the SAP allowed the employee to return to work before completing the recommended rehabilitation, they must continue and complete all rehabilitation and provide documentation of such to the program administrator.
- Additionally, the employee must complete all follow up testing recommended by the SAP to keep their card status valid.

| Other important information: |
- SAPs must have qualifying credentials to perform evaluations for this program. SAPs must have the same credentials as required for DOT. Not all substance abuse counselors have these credentials. Midwest Toxicology Services can provide information on approved SAPs and we can assist in locating a SAP in your area if one isn't already set up.
- Owner requirements
- If your employee has a violation, immediately remove the employee from the owners' job site if the owner requires the employee to possess a valid card. Only you can evaluate your liability to allow this person to work for you on other sites, who could be impaired from previous use of drugs.
- Some owners may have more stringent policies regarding individuals who test positive. We advise that you be knowledgeable of each owner's positive test re-entry policy.
